Welcome to www.plebgraph.com(referred to as "the Site") operated by PLEBGRAPH FINANCE PRIVATE LIMITED, trading as Plebgraph. We utilize our proprietary software, algorithms, and credit marketplace platform to provide loans to our customers. The entire process, including credit assessment, KYC processing, credit approval, and financing of loans, is managed by RBI-registered NBFC 'PLEBGRAPH FINANCE PRIVATE LIMITED' and other RBI-registered NBFCs in collaboration with Plebgraph. The collection of repayments and EMIs is also handled by Plebgraph.

Before accessing and using the Site, you are required to carefully review and accept all the terms and conditions outlined in the Terms of Use (ToU) and the linked Privacy Policy. Please note that we reserve the right to change or modify the Terms of Use at our sole discretion without prior notice. The headings used in this agreement are for reference purposes only. All individuals (referred to as "customers" or "users") visiting the website www.plebgraph.com are obligated to read and understand the Terms of Use before proceeding to use the Website. By using this site, "customers" or "users" implicitly confirm that they have reviewed, agreed to, and will adhere to the Disclaimer, ToU, and Privacy Policy.

Terms and Conditions for Loan Application:

  1. The user hereby acknowledges and accepts the applicable schedule of charges, fees, commissions, including the key facts provided by Plebgraph, as detailed in the "Schedule of Charges" in this policy.
  2. Goods & Services tax and/or any other relevant taxes will be applied and charged in connection with the loan.
  3. No discounts, free gifts, or commitments of any kind will be offered to customers by Plebgraph or any authorized representatives, beyond what is documented herein.
  4. Plebgraph will not process incomplete or defective application forms. In the event of any loss or delay caused to customers due to this, Plebgraph shall not be held liable.
  5. Submission of a loan application to Plebgraph does not guarantee automatic approval. The final loan amount is determined at the sole discretion of the Financer, who may choose to approve or reject the application.
  6. The Financer reserves the right to disclose customer information, including personal details, loan information, defaults, and security, to entities like the Credit Information Bureau of India (CIBIL), governmental/regulatory/statutory bodies, credit bureaus, RBI, Financer's branches/subsidiaries/affiliates, rating agencies, service providers, other financial institutions, third parties, assignees, or transferees. This information may be used for KYC verification, credit risk analysis, or other related purposes. Customer names may also be included in the wilful defaulter's list as required.
  7. The Financer retains the right to reject loan applications and retain the associated forms, photographs, and documents.
  8. In cases of delayed payments, the Financer is entitled to recover penal charges as described in the Schedule of Charges.
  9. Customers agree to provide additional documents as requested by the Financer.
  10. Customers confirm that there are no legal or judicial impediments or restrictions against them or their assets reported by other banks or financiers.
  11. Funds from the loan shall be used for the intended purpose, and not for speculative or antisocial activities.
  12. The information provided by customers is accurate and true.
  13. The Borrower confirms they are not a Politically Exposed Person (PEP). In the event that they or any of their family members/close relatives become a PEP, they will promptly inform the lender. The lender will then seek senior management approval to maintain the business relationship and conduct Customer Due Diligence procedures as required for PEP category customers.

Other declarations:

  1. Customers will notify Plebgraph in writing of any changes to their residential or employment address.
  2. Customers authorize and consent to the Financer disclosing the information provided in the application form and related documents to other branches, subsidiaries, affiliates, Credit Bureaus, Rating Agencies, Service Providers, banks, financial institutions, governmental/regulatory authorities, or third parties for information verification, credit risk analysis, or other relevant purposes. Customers waive the privilege of privacy and privity of contract.
  3. Customers confirm that they have received, read, and understood the terms and conditions applicable to this loan, including the application form and the Terms and Conditions/Agreement, and accept them.
  4. Customers confirm their Indian citizenship.
  5. Customers acknowledge that Plebgraph is not liable for any delay or non-delivery of products or the quality, condition, fitness, suitability, or other aspects of the products.
  6. Customers declare that neither they nor their family members are politically exposed persons. Any change in this status will be promptly reported in writing. False declarations may result in prosecution under applicable laws, rules, and regulations.

Customers also confirm that:

  1. In the case of loan cancellation, pro-rata Annualized Percentage Rate on any outstanding loan amount will be borne by them. Processing Fees are non-refundable and will not be waived or refunded in case of loan cancellation or non-disbursement.
  2. Any online sanction or loan communication received by customers represents conditional approval and is subject to the final sanction issued by the Financer after receipt of all necessary documents, including KYC documents.
  3. Loan-related information, such as the "welcome letter," "key fact statement," "repayment schedule," "Terms and Conditions," and "disbursal advice" (as applicable), will be sent to the email address provided by customers in the loan application form.
  4. Customers can access the welcome letter and repayment schedule on the Plebgraph Mobile App. They may request a physical copy of these documents separately if needed.
  5. The Financer reserves the right to transfer the loan to another entity at its discretion.
  6. Customers must inform the Financer of any discrepancies or concerns regarding statements within 15 days of receipt. However, such discrepancies do not entitle customers to default or delay loan installment payments based on inaccuracies in the statement of account.
  7. The Sanctioned Loan, interest, additional penal charges, fees, expenses, and all other sums payable to the Financer may be secured by the product on which the Financer holds exclusive rights, except for products where no lien is allowed by law, such as jewelry items. Loans associated with such products will be considered unsecured.

PAYMENT OF EMI DUES:

Customers hereby agree to the following terms and conditions:

  1. Customers have provided a NACH Mandate in favor of the Financer, covering all amounts due under these Terms & Conditions, including EMIs for the Sanctioned Loan as stipulated herein, or they confirm their agreement to pay the amounts due to the Financer on or before the dates provided in the repayment schedule.
  2. Customers will ensure the availability of funds in the account from which such NACH Mandate has been drawn. Customers will not close their account or issue any notice instructing the Financer not to present any NACH Mandate for the repayment of EMIs as required under these Terms & Conditions.
  3. As part of the loan application, the Financer may need to access the Customer's CIBIL/Credit score. Customers authorize the Financer to make inquiries with other financial companies, banks, or registered credit bureaus regarding their credit history.
  4. Customers consent to receiving telephonic calls, SMS messages on their mobile number provided in the Application Form, or through any other communication mode regarding various loan offers, loan promotional schemes, or any other promotional schemes offered by the Financer. Customers acknowledge that laws related to unsolicited communication under the "National Do Not Call Registry" (NDNC Registry) do not apply to such communications from the Financer, its employees, or agents. Customers have also read and agreed to the privacy policy of Plebgraph at www.plebgraph.com/privacy-policy.
  5. The loan will be governed by separate terms and conditions and/or other documents ("Loan Documents") entered into with the Financer. In case of any inconsistency between these terms and conditions and the provisions of the Loan Documents, the provisions of the Loan Documents shall prevail.
  6. Plebgraph is solely responsible for the website www.plebgraph.com and all its contents, as well as any data or information submitted on the website, and for all products and services offered therein.

Other terms & conditions

  1. It is the sole responsibility of the Customer to keep their username and password confidential and not disclose them to any third party, including representatives of Plebgraph or its agents. Customers shall take all necessary precautions to prevent the discovery of their username or password by any unauthorized person.
  2. Plebgraph makes no representations regarding the timeliness of the services contained on the Plebgraph website for any purpose.
  3. Plebgraph makes no representations regarding the suitability, reliability, or availability of the services contained on the Plebgraph website for any purpose.
  4. Plebgraph shall not be held responsible if any information, database, statement, certificate, or page is printed or downloaded from Plebgraph's site, and after printing or downloading, the text or information is altered, removed, or obscured.
  5. Plebgraph, under no circumstances, shall be liable for any direct, indirect, punitive, incidental, special, or consequential damages, or for any damages resulting from delay or inability to use the Plebgraph website, failure to provide services, or any information, data, statement, certificate, software, or other services obtained through the Plebgraph website, or otherwise arising from the use of the Plebgraph website.
  6. Plebgraph reserves the right to suspend these services if, in Plebgraph's opinion, the security of the site or the data could be compromised.
  7. Plebgraph may also suspend services on the website for any customer at its sole discretion without providing any reason. In such an event, the user should contact Plebgraph offices for clarification.

Interest on Loan:

The interest component depends on the product and the chosen repayment period. The interest component ranges from 8% to 30%.

Note: The interest component represents the interest amount as a percentage of the product value. Interest is calculated using a reducing balance method. The interest component on new loan applications may change periodically, and Plebgraph does not assume responsibility for notifying or informing Customers about such changes. Processing fees:

The processing fee can either be a fixed amount or a percentage of the loan amount, depending on the loan amount and selected repayment period.

Note: The processing fee for new loan applications may change periodically, and Plebgraph does not assume responsibility for notifying or informing Customers about such changes. To find out the most up-to-date processing fees applicable to loans, please send an email to support@plebgraph.com.

Important Notes:

  1. One-Time Overdue Charges and Daily Penal Charges will be applied if the EMI repayment is made after the scheduled due date or as otherwise specified in the Financing Document. These are collectively referred to as "Overdue Penalty Charges."
  2. The total penal charges levied on the borrower per EMI will be the lower of INR Rs. 2000, 100% of the principal outstanding, or the amount calculated according to the details provided in the Overdue Penalty Charges grid above.
  3. Whenever updates to the fees and charges are introduced by the Lenders, the borrower will be notified of such changes via email or through methods prescribed by the Lenders from time to time. The borrower must ensure that their latest mobile number and email ID are updated with the Lenders. The Lenders will rely on the mobile number and email ID provided by the borrower and will not be obligated to verify their validity. The borrower cannot dispute such reliance by the Lenders.

Changes to Website or Policy:

  1. Plebgraph reserves the right to modify the User Interface, appearance, contents, organization, location, and accessibility of the Website and/or the Policy on Website Use at any time without prior notice.
  2. Users are expected to stay informed about any changes made to this Website and the information available on it on a regular basis. Plebgraph assumes no responsibility for advising or notifying Users about such changes.
  3. It is essential to note that Plebgraph has made reasonable efforts to ensure that the information, statements, and certificates provided on Plebgraph's Website are accurate. However, Plebgraph does not guarantee their accuracy, completeness, suitability, correctness, adequacy, or validity for any purpose. The provided database is without any warranty, express or implied, regarding its legal effect.

Non-Compliance with Policy/Terms of Website Use

If a User breaches the terms and conditions/Policy on Website Use, or if there is suspicion of such a breach, necessary actions may be taken, including: (i) sending one or more formal warnings; (ii) temporarily or permanently blocking access to the Website; (iii) blocking all computers/devices using the User's IP address from accessing the Website; (iv) requesting internet service providers to block access to the Website; (v) commencing legal action for recovery of amounts due or damages arising from the breach; and/or (vi) suspending or deleting the User's account on the Website. The User hereby agrees to indemnify and hold Plebgraph harmless from any claims, actions, liability, costs, loss, or damages arising from their access to the Website.

The Website may contain links to sites not under Plebgraph's control. If Users visit any of these links, it is their responsibility to review each site's terms of use. Plebgraph assumes no responsibility or liability for any obligations or offers on such sites and is not responsible for their contents, policies, practices, or any loss, damage, or expense arising from the use of such sites.

Governing Law

The use of this Website and the Policy on Website Use shall be governed by Indian law. The Policy on Website Use and activities under this Policy constitute an 'electronic record' as defined in the (Indian) Information Technology Act, 2000.

Limitation of Liability

  1. While Plebgraph has taken precautions to make the database reliable, Plebgraph will not be held responsible for any liability arising from errors in the database. Additionally, Plebgraph does not claim that its Website is free of viruses or harmful components.
  2. Use of any information, statements, or certificates on Plebgraph's Website is at the User's own risk and should be in accordance with applicable laws. Plebgraph, its subsidiary companies, affiliates, directors, and employees disclaim all liability for any loss or damage directly or indirectly resulting from the use of this Website.
  3. If a transaction, statement, or certificate does not align with the User's records or the information they possess, they are encouraged to contact Plebgraph at support@plebgraph.com for clarification.
  4. Plebgraph provides information/database on the Website on an "as is where is" basis. Plebgraph expressly disclaims all warranties, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
  5. Plebgraph disclaims all responsibility for any loss, damage, or expense arising from, but not limited to, any defect, error, omission, interruption, imperfection, fault, mistake, or inaccuracy with this Website, its Contents, or associated services, or due to any unavailability of the website or any part thereof or any contents or associated services, even if the Entities are advised of the possibility of such damages, losses, or expenses.

Force Majeure

Plebgraph and/ or Partner Financial Institution shall not be liable for its failure to perform under the T&Cs as a result of the occurrence of any force majeure events including an act of God, fire, wars, sabotage, civil unrest, labor unrest, the action of statutory authorities or local or central governments and/or change in Applicable Law, that may affect the performance of Plebgraph, Partner Financial Institution, payment gateways and/or the Partner Merchant.

Governing Law and Dispute Resolution

These User Terms shall be governed by, and construed in accordance with, the laws of India, without reference to principles of conflicts of law. The parties agree that the courts of Mumbai shall have exclusive jurisdiction over any dispute arising from or relating to the User Terms and/or the Website.

You expressly consent to the personal jurisdiction of said courts and waive any objection to such personal jurisdiction based on forums non-convenience or any other basis.
